This policy explains what personal data SMART collects through this website, why we collect it, who receives it and what rights you have.

1. Who is responsible for your data

Sistemas Móviles Avanzados de Rastreo y Tecnología, S. de R.L., trading as Smart S. de R.L. ("SMART", "we", "us"), is the controller of the personal data collected through https://www.smt.hn (the "Website").

2. What data we collect

• Contact form: your name, company, WhatsApp number and email address, and, if you choose to provide it, a short message.
• Launch notification form: your email address.
• Automatically: IP address, browser and device type, language, date and time of access, and technical data needed to keep the Website secure.

We do not ask for sensitive data (such as health, financial or identity documents). Please do not send it to us.

3. Why we use your data and on what basis

• To contact you by WhatsApp, phone or email, confirm that we received your request, answer it and give you information about our services. Basis: your consent, which you give by checking the box on the form.
• To email you when our new website launches. Basis: your consent.
• To protect the Website against spam and abuse and keep it secure, including Google reCAPTCHA. Basis: our legitimate interest in keeping our systems safe.
• To comply with legal obligations and to establish or defend legal claims. Basis: legal obligation and legitimate interest.

We do not sell your data, we do not use it for any other purpose, and we do not make automated decisions about you. When you ask us to contact you, our team will be the one to start the conversation.

4. Who receives your data

Only the providers we need to operate the Website, under their own terms and privacy commitments:

• Vultr: hosting provider for the servers where the Website and its data are stored (United States).
• Google reCAPTCHA: anti-spam check when you send a form (Google LLC, United States). Google's Privacy Policy and Terms of Service apply.
• WhatsApp (Meta): when our team writes to you on WhatsApp, the messages are processed under WhatsApp's own terms.
• Microsoft (Outlook / Microsoft 365): the email service we use to send and receive emails, including the confirmation we send you when you contact us and any reply you send (Microsoft Corporation). Microsoft's terms and privacy statement apply.

The Website runs on software installed on our own servers. We do not share your data with anyone else unless the law requires it or you authorize it.

Because some of these providers are in the United States, your data may be stored and processed outside Honduras.

5. How long we keep your data

We keep your data for 24 months from your last interaction with us. After that, we delete or anonymize it, unless you ask us to delete it earlier or the law requires us to keep it longer.

6. Your rights

You can ask us to:

• give you access to your personal data;
• correct data that is inaccurate;
• delete your data;
• limit how we use it, or object to its use;
• give you a copy of your data in a common, readable format;
• withdraw your consent at any time. Withdrawing consent does not affect the processing done before.

To exercise these rights, write to info@smt.hn with your name and your request. We may ask you to confirm your identity. We will answer within 30 days. Every email we send includes a link to unsubscribe. You may also contact the competent data protection authority of your country, if there is one.

7. Cookies

We only use technical cookies that are necessary for the Website to work: to remember your language, keep your session secure and store your time zone. We do not use analytics, advertising or remarketing cookies. Google reCAPTCHA may set its own cookies for security purposes. You can block cookies in your browser, but the forms may stop working.

8. Security

The connection to the Website is encrypted with HTTPS, access to the data is limited to authorized staff, and we keep backups. No system is completely secure, but we take reasonable technical and organizational measures to protect your information.

9. Minors

The Website is intended for businesses and adults. It is not directed to people under 18. If you believe a minor has given us personal data, write to info@smt.hn and we will delete it.

10. Changes to this policy

We may update this policy. The date at the top shows the latest version, and we will announce important changes on this page.

11. Governing law

This policy is governed by the laws of Honduras. Any dispute will be resolved by the courts of San Pedro Sula, without affecting any rights you may have under the mandatory laws of your country of residence.
